PCTEL adds to Wi-Fi line with purchase of MAXRAD

PCTEL, (See http://www.pctel.com/index.php) the Chicago wireless
communications technology company, has acquired MAXRAD,
(See http://www.maxrad.com/index.cgi)  a Hanover Park maker of antennas for
wireless systems, expanding its wireless product line.

"We're very excited about this acquisition," Chairman Martin Singer said of
the $20 million purchase. "This helps us expand in the wireless arena.
Everything we do now is wireless."

Singer said Monday there are no plans for layoffs at MAXRAD, which employs
about 90, most of them in Hanover Park. The acquisition doubles PCTEL's
staff. The new company has 115 employees in the Chicago area.

Steve Deppe, MAXRAD's president, will continue with PCTEL as a vice
president and general manager of the MAXRAD operation.

He said customers will benefit "from the enhanced synergies that come from
being part of a larger focused wireless organization."

Privately held MAXRAD is a major supplier of antennas to manufacturers of
wireless equipment, including Motor-ola's two-way radios for public safety
agencies, Cisco's routers, Trimble's Global Positioning System devices and
Proxim's Wi-Fi access points.

Germantown, Md.-based DTI, which PCTEL acquired last March, purchases MAXRAD
antennas for software-defined radios used by cellular phone companies to
test their systems and eliminate interference and by government agencies and
the military to find and block intruders on secure radio networks.

Singer noted MAXRAD has had significant growth in ant-ennas for Wi-Fi
devices, a major PCTEL focus.

He added that MAXRAD also was an attractive acquisition because "it has an
incredibly well-established distribution network, reaching markets of
interest to us," such as government agencies.

He said he expects the MAXRAD unit will generate about $20 million in sales
this year, adding to the $30 million estimated for the rest of PCTEL.

PCTEL last year exited the modem business to devote itself to emerging
wireless opportunities, especially Wi-Fi products.

PCTEL developed the Segue Roaming Client to help people using Wi-Fi to
seamlessly roam from one Wi-Fi network to another and to cellular networks.
Shares closed Monday at $11.06, up 36 cents, or 3.4 percent.

M/A-COM, Inc., a business unit of Tyco Electronics and a leading
manufacturer of critical radio systems deployed around the world, was
awarded a $5 million contract to provide a digital wireless communications
system for the Central Arizona Project (CAP) (See
http://www.cap-az.com//index.cfm).

M/A-COM will implement its OpenSky solution, a wireless private
communications network based on Internet Protocol (IP) technologies that
will connect more than 400 Central Arizona Project personnel and provide
direct interoperability between CAP and emergency, municipal and other
utility agencies. The OpenSky technology also will allow Central Arizona
Project to host four conversations on each of their existing radio channels,
substantially improving system capacity.

Central Arizona Project operates and maintains a 336 mile long aqueduct that
delivers water from the Colorado River to central and southern Arizona,
providing a renewable source of water for residential, industrial and
agricultural uses. M/A-COM is deploying an 800 MHz OpenSky digital wireless
network for integrated voice and data connectivity along the entire aqueduct
and along roads in the region. A key safety element of this digital wireless
system is the incorporation of GPS (Global Positioning System) into each
mobile radio.

"The Central Arizona Project is the largest source of renewable water supply
across central and southern Arizona," said Bruce Wilcox, Electronics
Department Manager of Central Arizona Project. "Safeguarding this
installation is critical for the well being of the state because it impacts
everything from farming and irrigation to safe and clean drinking water.
M/A-COM offered a network solution that will easily adapt to our current
communications systems. OpenSky's TDMA technology will give CAP additional
voice capacity and data capability while improving coverage in the more
rural areas of our service area, helping to ensure the safety of our
employees and the public."

Design and installation of the system has begun with full implementation to
be completed in the summer of 2004. In addition to ground communications,
M/A-COM's OpenSky IP network will provide interconnectivity with all of the
Project's helicopters, which operate on conventional VHF channels. This is
accomplished with M/A-COM's IP gateways, which establish permanent and
user-transparent links between different radio systems.

voice and data communications between municipal, utility and public safety

(IP) and a time-division multiple access (TDMA) airlink - allows for

operation. I need simple location on demand information without any
telemetry type functions.

I would like some input on the advantages and disadvantages of satellite
applications, cellular applications, typical recurring costs, and
experience with tracking service providers and equipment manufacturers.

I would also like advice from people who have added AVL to an existing
two-way radio system; equipment options, software options, etc.

I'm not impressed. From a quick look at the site, it has some basic
problems, such as complaining about not being able to take your phone
from a TDMA carrier to a CDMA carrier. I don't know of any phones that
do both. Then again, I'm only a cellular user.  

I've always been given literature with a disclaimer about coverage. Not
only when I first signed up, but when I changed plans too. As for
billing, I've only had one problem since I first got a cell phone back
in 1986 and that was a typo when I upgraded my plan which cost me $30.00
and was promptly credited and the typo resolved when I noticed it on my
bill.

I would have thought an outfit like Consumer's would have done at least
some basic research on the subject but it doesn't look like it.

Motorola gets license on tracking tech

Motorola Inc. is licensing wireless technology (See http://www.woz.com/)
from a startup led by Apple Computer co-founder Steve Wozniak to develop
devices and services that can monitor the locations of people, pets or
important possessions.

The vague announcement, slated for release Thursday, does not call for the
development of any particular type of device or the addition of the
technology to specific products already made by Motorola such as cell
phones, pagers and walkie-talkies.

Still, the deal marks the first major technology endorsement for Wheels of
Zeus Inc., which hopes to parlay a combination of innovation and Wozniak's
cachet into success despite the existence of other devices that can track
the location of children, pets and Alzheimer's patients.

"We're trying to make new inroads and do something that has been done at
higher cost and bring it down to everyday prices," Wozniak said in an
interview with The Associated Press.

The wireless platform, dubbed "wOzNet" as a play on Wozniak's nickname, uses
a wireless tag that picks up signals from global positioning satellites,
then transmits that information up to several miles to a base station or
other receiving device using a low-power radio signal - the same spectrum
used by many cordless phones.

Motorola plans to use the technology within its home broadband division,
which makes cable TV boxes, modems and wireless networking products.

More specific product announcements could come later in 2004, both companies
said.

Potential product developments might include a standalone tracking device
and base station as well as integration within cell phones and other
portable devices, personal computers and future home networking systems.

Likewise, the wireless tracking is handled in different ways. One
possibility is direct communication between two devices.

"Let's say you're a parent, you have four kids, and as soon as they hit the
amusement park they run in four directions," said Vince Izzo, director of
business development in consumer solutions business for Motorola Broadband.
"You could set the thing to let you know if any of them is more than 50 feet
away from you."

Going a step further, if a parent wants to monitor an older child without
going to the amusement park, a cell phone company or the operators of the
park could track the child's location and transmit that information over the
Internet to a base station at home.

Wozniak said he personally prefers the notion of using a device and base
station designed specifically for tracking rather than incorporating the
technology in a cell phone and a home computer.

"I don't like the approach where the computer gets used for 10 different
things," he said. "If the thermostat is on the wall, leave it on the wall. I
don't like complicating your computer life."

He'd also rather have the tracking devices communicate directly rather than
through a service provider charging a fee. Between regular telephone
service, cellular, cable TV and Wi-Fi, "People are getting a little leery of
one more high-priced monthly service bill," Wozniak said.

Gina Clark, vice president of marketing and business development for Wheels
of Zeus, said the company continues to seek other partners in developing
uses for its technology, but that "our premier partner is clearly Motorola"
for consumer products.

M/A-COM, Inc., a business unit of Tyco Electronics and a leading
manufacturer of critical radio systems deployed around the world, was
awarded a $5 million contract to provide a digital wireless communications
system for the Central Arizona Project (CAP) (See
http://www.cap-az.com//index.cfm).

M/A-COM will implement its OpenSky solution, a wireless private
communications network based on Internet Protocol (IP) technologies that
will connect more than 400 Central Arizona Project personnel and provide
direct interoperability between CAP and emergency, municipal and other
utility agencies. The OpenSky technology also will allow Central Arizona
Project to host four conversations on each of their existing radio channels,
substantially improving system capacity.

Central Arizona Project operates and maintains a 336 mile long aqueduct that
delivers water from the Colorado River to central and southern Arizona,
providing a renewable source of water for residential, industrial and
agricultural uses. M/A-COM is deploying an 800 MHz OpenSky digital wireless
network for integrated voice and data connectivity along the entire aqueduct
and along roads in the region. A key safety element of this digital wireless
system is the incorporation of GPS (Global Positioning System) into each
mobile radio.

"The Central Arizona Project is the largest source of renewable water supply
across central and southern Arizona," said Bruce Wilcox, Electronics
Department Manager of Central Arizona Project. "Safeguarding this
installation is critical for the well being of the state because it impacts
everything from farming and irrigation to safe and clean drinking water.
M/A-COM offered a network solution that will easily adapt to our current
communications systems. OpenSky's TDMA technology will give CAP additional
voice capacity and data capability while improving coverage in the more
rural areas of our service area, helping to ensure the safety of our
employees and the public."

Design and installation of the system has begun with full implementation to
be completed in the summer of 2004. In addition to ground communications,
M/A-COM's OpenSky IP network will provide interconnectivity with all of the
Project's helicopters, which operate on conventional VHF channels. This is
accomplished with M/A-COM's IP gateways, which establish permanent and
user-transparent links between different radio systems.

"We are honored to have been awarded such an important and critical project
for the state of Arizona," said Tom Hoyne, Director, Utility Markets for
M/A-COM, Inc. Capacity and interoperability were critical factors in CAP's
decision criteria and M/A-COM was selected because our solution best met
those requirements. M/A-COM offered a fully interoperable 800 MHz
communications network that will enable CAP personnel to tap into outside
public safety agencies and first responders in times of crisis."

The OpenSky system is a wireless private network that enables efficient
voice and data communications between municipal, utility and public safety
departments. The technology behind OpenSky - end-to-end Internet Protocol
(IP) and a time-division multiple access (TDMA) airlink - allows for
multiple features including:

  a.. Digital and analog radio interoperability with systems of any type,
including those not part of the OpenSky network
  b.. Enhanced data capability for quick exchange of data files, including
work orders and telemetry, with mobile and fixed devices
  c.. Efficient use of radio frequencies by allowing four simultaneous

MEMORANDUM OPINION AND ORDER


   Adopted:   January 7, 2004 Released:  January 8, 2004

By the Chief, Public Safety and Critical Infrastructure Division, Wireless
Telecommunications Bureau:

1. Introduction.  We have before us a request for waiver of Section 90.20(d)(47)
of the Commission's Rules  filed by the County of Dukes County, Massachusetts,
Office of the Sheriff (Dukes), on June 12, 2002 (Dukes Waiver Request).   Dukes
seeks the waiver in order to utilize frequency 166.250 MHz for public safety
operations 175 miles from New York City.   For the reasons discussed below, we
grant the Dukes Waiver Request.  Furthermore, on our own motion, we grant Dukes
a waiver of Section 2.106, note US11,  of the Commission’s Rules so that it may
utilize frequency 166.250 MHz for public safety operations.
2.  Background.  Frequency 166.250 MHz is allocated to Federal Government
(Government) use on a primary basis.   Additionally, non-Federal Government
(non-Government) operations on this frequency are authorized on a secondary,
non-interference basis to Government operations.   Specifically, non-Government
remote pickup broadcast base and land mobile stations are authorized at points
more than 150 miles of New York City, and non-Government base, fixed and land
mobile stations in the Public Safety Radio Services are authorized at points
within 150 miles of New York City.
3. Dukes is responsible for providing emergency communication services to all
local police, fire and EMS, with all dispatch services emanating from the Dukes
County Sheriff’s Communication Center at Martha’s Vineyard Airport in Martha’s
Vineyard, Massachusetts, approximately 173 miles from New York City.   Dukes
asserts that in an effort to overcome the problem of radio “dead spots” created
by the hilly terrain on the west side of the island, it constructed an antenna
tower on the highest hill in the area, and is in the process of installing
antennas.  However, Dukes asserts that it is experiencing frequency congestion
that could be overcome by use of frequency 166.250 MHz.   Thus, Dukes requests a
waiver of Section 90.20(d)(47).
4. In conjunction with its waiver request, Dukes has filed a memorandum from the
International Municipal Signal Association (IMSA), an FCC-certified frequency
coordinator for the Public Safety Pool, supporting Dukes’ request.   IMSA states
that allowing Dukes to use frequency 166.250 MHz is “an ideal solution to the
difficult problem of finding a suitably clear Public Safety channel for an
island with huge seasonal population differentials and thus communications
needs.”   IMSA further indicates that “[e]xtensive searching revealed that the
extreme congestion in the VHF bands and the susceptibility of Martha’s Vineyard
to radio interference from Cape Cod, Rhode Island, Connecticut and Long Island,
NY based stations preclude…frequency coordination for a Fire or EMS channel, and
for inter-service frequencies from other public safety [frequency
coordinators].”   IMSA also submitted an amendment to its memorandum, including
an attachment setting forth the public safety frequencies, and demonstrating
that none of these frequencies are available or technically feasible.
Furthermore, given its location (four miles off the southern coast of
Massachusetts) and proposed power level (10 watts total power output for the
base station), granting the captioned application “would cause no greater impact
on [remote pickup broadcast licensees]” as compared to the impact from higher
power public safety licensees within 150 miles of New York City.   In this
connection, on October 8, 2003, Dukes filed letters of concurrence from Hall
Communications, Inc. and Sandab Communication, LTD, co-channel licensees
operating on frequency 166.250 MHz in New Bedford, Massachusetts, and
Barnstable, Massachusetts, respectively, acceding to Dukes’ proposed operations.

5. Discussion.  To obtain a waiver of the Commission's Rules, a petitioner must
demonstrate that a grant of the waiver would be in the public interest and the
underlying purpose of the rule(s) would be frustrated or not served by
application to the present case.   Alternatively, a petitioner must show that,
in view of unique or unusual factual circumstances, application of the rule(s)
would be inequitable, unduly burdensome, or contrary to the public interest, or
that the applicant has no reasonable alternative.  Based on the record in this
proceeding, we find that the request for waiver of Section 90.20(d)(47) of the
Commission's Rules is warranted because Dukes has demonstrated that it is faced
with unique factual circumstances such that application of the rule would be
contrary to the public interest, and Dukes has no reasonable alternative.
6. We find that Dukes’ geographical area of operation presents unique factual
circumstances.  In this regard, we acknowledge Dukes’ representation that it is
attempting to remedy the problem of radio dead spots due to the hilly terrain in
certain areas of Martha’s Vineyard.  Additionally, we credit IMSA’s contention
that the huge seasonal population differentials have resulted in unique
communications needs.  Furthermore, the susceptibility of Martha’s Vineyard to
radio interference from four different areas—namely, Cape Cod, Rhode Island,
Connecticut and Long Island, N.Y.—also place Martha’s Vineyard in a unique
situation.  We also are persuaded that granting the requested waiver is in the
public interest because it would significantly enhance Dukes' coverage, system
reliability, and ability to dispatch emergency communications in the Martha’s
Vineyard area, thereby promoting effective public safety communications.
7. In addition, we find that Dukes has no reasonable alternative.  In this
regard, we note IMSA's assertion, supported by an extensive search of the Public
Safety Pool VHF frequencies, that extreme congestion in the VHF bands and the
susceptibility of Martha’s Vineyard to radio interference from surrounding areas
precluded frequency coordination of a Fire or EMS channel and for inter-service
frequencies from other public safety services to meet the identified
communications need.  We further note that IMSA has provided an annotated
printout of public safety channels from Local Government, Fire, Police, Highway
Maintenance, Emergency Medical, Special Emergency and Forestry Conservation
Radio Services that have been examined and determined to be unavailable or
technically infeasible.   Therefore, we grant Dukes’ request for a waiver of
Section 90.20(d)(47) of the Commission’s Rules.
8. In a related matter, we note that in addition to obtaining a waiver of
Section 90.20(d)(47), Dukes must also obtain a waiver of note US11 to the Table
of Frequency Allocations in Section 2.106 of the Commission’s Rules to operate
on 166.250 MHz.  As discussed above, like Section 90.20(d)(47), note US11
restricts assignment of 166.250 MHz for public safety operations to within 150
miles of New York City.  Although a waiver of note US11 is likewise required,
Dukes has not requested a waiver thereof.  Therefore, on our own motion, we
grant Dukes a waiver of note US11, for reasons discussed above.
9. As noted above, non-Government use of 166.250 MHz is secondary to Government
use.  As such, this waiver is issued subject to the condition that harmful
interference will not be caused to Federal government stations.  Dukes is hereby
advised that Federal government stations may be transitioning to narrowband
operations and most are required to do so by January 1, 2005, i.e., operating
12.5 kHz bandwidth equipment--in some cases using center frequencies "offset"
12.5 kHz from Dukes’ center frequency(s).  Federal government stations are
licensed by the National Telecommunications and Information Administration
(NTIA).  Information on the Federal government's transition to narrowband
operations is available on NTIA's Office of Spectrum Management home page at:
http://www.ntia.doc.gov/osmhome/osmhome.html.  Non-Federal licensees should also
note that operation of "25 kHz equipment" increases the likelihood of causing
interference to Federal government stations.  If interference is caused,
non-Federal users must cease operating and modify operations so as not to cause
harmful interference to Federal government stations.
10. Accordingly, IT IS ORDERED that, pursuant to Section 4(i) of the
Communications Act of 1934, as amended, 47 U.S.C. § 154(i), and Sections 1.3 and
1.925 of the Commission's Rules, 47 C.F.R. §§ 1.3, 1,925, the Request for Waiver
filed by the County of Dukes County, Massachusetts, on January 18, 2002, IS
GRANTED, as set forth above.
11.   IT IS FURTHER ORDERED, pursuant and Section 4(i) and 309(a) of the
Communications Act of 1934, as amended, 47 U.S.C. § 154(i), 309(a), that the
Licensing and Technical Analysis Branch SHALL PROCESS FCC File No. 0000819118 in
accordance with the Commission’s Rules and this Memorandum Opinion and Order.
Any grant of the captioned application SHALL BE CONDITIONED as set forth in
paragraph 9, above.
12. This action is taken under delegated authority pursuant to Sections 0.131
and 0.331 of the Commission’s Rules, 47 C.F.R. §§ 0.131, 0.331.

It makes me wonder what you're so afraid of - a little competition?
I'll support any new policy initiatives that will make the cell phone market
more competitive, such as:
· Better information about where a cell phone will work before I buy a service
plan.
· Pro-rated early contract termination charges - consumers shouldn't have to pay

per phone.

Verizon Wireless today announced that it plans to expand
its CDMA2000 1XEV-DO deployment beyond the current
two markets -- San Diego and Washington, D.C. -- effectively
upping the ante on the U.S. wireless broadband data landscape.

1XEV-DO offers speeds of 300 to 500 kilobits per second, or about 10 times the
average dial-up connection speed. That will be a significant increase over AT&T
Wireless' EDGE network, which currently claims to be the fastest wide-area
network in the United States. AT&T Wireless launched its EDGE service nationwide
late last year and the service offers data rates of about 140 kbps.   

Verizon says it will spend $1 billion over the next two years to launch the
EV-DO network. But unlike its initial commercial deployment last fall, which
focused on enterprises users, Jim Straight, the carrier's president of wireless
data and Internet service, said the company's nationwide deployment will be
marketed to both consumers and enterprises. Verizon plans to have a number of
EV-DO handsets available to consumers this year, Straight says.

Verizon sees a huge opportunity in the consumer market for high-speed services
such as video and high-resolution photos, Straight said. Consumers also will
want a wider selection of devices than the laptop PCMCIA card that is now
available, he said. "This is going mass market," Straight said in an interview.
"There are a lot more devices coming."

The introduction of EV-DO handsets and the focus on the consumer market is
significant, according to analyst Iain Gillott, president of iGillott Research.
"I've seen the other EV-DO stuff such as PDAs and handsets and they are very
cool. They can do music and true multimedia."

In addition, Gillott says, Verizon's deployment likely will increase the gap
between CDMA and GSM networks in the United States. "This announcement just made
the chasm between CDMA and GSM/GPRS a little bit wider."

Straight said the carrier will have a number of EV-DO devices this year,
including a one-megapixel camera phone. He also said Verizon Wireless will
support most operating systems, including Palm and Microsoft, although he
declined to go into specifics.

The carrier didn't provide any timeline for its EV-DO rollout except that it
will occur city by city over the next two years. Straight declined to say how
many cities might be launched by year-end.

An industry source told Wireless Week that Verizon Wireless pushed up the
nationwide  launch because of the success it has had in San Diego and
Washington, D.C. The source said Verizon Wireless had more customers on it EV-DO
network in those cities than on its slower 1X data network, which was launched
nearly two years ago.

Straight confirmed that the EV-DO launch went much better than expected. Its
subscriber numbers outpaced the 1X launch in the first months, he said,
declining to give specific numbers.

FCC TO HOLD OPEN COMMISSION MEETING THURSDAY, JANUARY 15, 2004

The Federal Communications Commission will hold
an Open Meeting on the subjects listed below on
Thursday, January 15, 2004, which is scheduled to
commence at 9:30 a.m. in Room TW-C305, at 445
12th Street, S. W., Washington, D.C.  The Meeting
will focus on presentations by senior agency officials
regarding implementations of the agency’s strategic
plan and a comprehensive review of FCC policies
and procedures.

Presentations will be made in five panels:

Panel One will feature the Managing Director and the Chief of the Office of
Strategic Planning and Policy Analysis in a joint presentation.

they went digital from analog service. my question can a cell phone
still dial 911 only, even if the service is outdated. for emergency
use only.

Most every phone has the capability to dial 9-1-1 even if you aren't
paying for service. Back in the days when we used Nextel for
radio-only, we told our folks that they could use them for 9-1-1 and I
called EMS dispatch on one of them to confirm it.

On another occasion, we had to take the phone switch down. I made
non-service radios available for 9-1-1 calls to several departments in
the building.

I won't say that it'll work with every phone and every place, but it's
worth a try.

Burger King customers told: 'You are too fat to have a Whopper'

Police believe teenage pranksters are hacking into the wireless 
frequency of a US Burger King drive-through speaker to tell 
potential customers they are too fat for fast food.

Policeman Gerry Scherlink said the pranksters told one customer who 
had just placed an order: "You don't need a couple of Whoppers. You 
are too fat. Pull ahead."

The offenders are reportedly tapping into the wireless frequency at 
the restaurant in Troy, Michigan. Police believe the culprits are 
watching and broadcasting from close range.

Officer Scherlinck said the men are telling customers who order a 
Coca-Cola that, "We don't have Coke." And when the customer asks 
what they do have, the hacker would say: "We don't have anything. 
Pull ahead."

But what has managers concerned is the profanity the hackers are 
using, according to police.

A drive-through customer has told police if he had children with him 
in the car and someone used profanity, he would have been upset.

Burger King franchise owner Tony Versace issued the following 
statement in response to the incidents: "We apologise to our 
customers who've been insulted by the use of this drive-through 
speaker."

Management at the fast-food restaurant are reportedly trying to 
change the radio frequency used for the speakers, reports Local 4.

A half century on, the blissfully naïve have
switched sides. Today it is obvious to regulators
that they cannot fathom the countless
shapes and sizes of wireless services, or the
potentially limitless configurations of wireless
markets. Private entrepreneurs must be unleashed
to discover the efficiencies beyond. As
the FCC’s Spectrum Policy Task Force Report
noted last year, “the government has an
almost impossible task trying to keep pace
with the ever-increasing demand for spectrum
and the continuing advances in wireless
technology and applications.”
From their lips to God’s ears. Despite frequent
press references to our “crowded radio
waves,” most of the valuable frequencies are
barely used. Rather, it is the lobby of the FCC
that is crowded – jam-packed with applicants.
It is no anomaly that federal rules keep 67
television channels in reserve for Springfield,
Mass., a city with just three TV stations on the
air. Indeed, to get a sense of the pervasive misuse
of a valuable natural resource, one need
only look at the variety of wireless services
that petitioners at the FCC would like to
deliver to the good people of Springfield by
using those idle channels.
Were competitors free to offer any noninterfering
wireless service, via any business
model at any frequency, the productivity
gains would be enormous. Given flexible
rights, spectrum licensees would become de
facto spectrum owners, and the search for
property improvements would be on.

student Leo Herzel’s proposal in the University of Chicago Law Review to auction
broadcast TV licenses.  Chiding Herzel’s blissful naïveté, Smythe scoffed that
markets could not possibly handle the complex task of coordinating airwave use.

Institute for Policy Research and a columnist for the Financial Times’ New
Economic Policy Forum.
Consumer benefits would run the gamut:
better coverage (and fewer dropped calls) on
cellular phones, faster (and less expensive)
broadband access to the Internet, wireless
competition to cable and satellite TV. Perhaps
most important are the creative applications
yet unknown.
The long march to a consensus among
economists was set in motion in 1959 by an
influential article in the Journal of Law and
Economics on the value of making markets in
spectrum by the University of Chicago’s Ronald
Coase, who would later win a Nobel Prize
in economics. It took policymakers decades to
catch on, but in recent years they have joined
the ranks of believers in droves. Two years
ago, 37 “concerned economists,” including the
aforementioned Nobel Laureate Coase, petitioned
the FCC to “eliminate all wireless
license requirements unrelated to interference
or anticompetitive concentration.”
Yet, when the Spectrum Policy Task Force
reported its findings, the consensus promoting
spectrum markets had mysteriously vaporized.
In fact, the task force called on regulators
to continue to assign spectrum use in
much the same way that has deprived Spring-
field of most of the benefits of the airwaves.
While flexibility was endorsed in theory,
plans to extend flexible rights to licensees
were largely set aside. New emphasis was
placed on imposing technical standards on
spectrum users – precisely the function best
left to free markets.

and assigning licenses
FCC regulation of radio spectrum is a twostage
process. In the first, “block allocation,”
the Commission decides what specific frequencies
shall be used for. Zoning each band,
the Commission defines services, prescribes
technologies, dictates business models and
mandates emission standards. It also determines
market structure. If it sets the band
aside for unlicensed use, it also controls interference
by setting power limits and regulating
the equipment permitted. For licensed bands,
regulators decide how many firms shall compete
and how much bandwidth each licensee
shall have.
The Commission then doles out licenses.
Since 1994, this has primarily been done via
auctions. Through 2002, high bids totaled $41
billion, though, thanks to defaults and legal
wrangling, only $14 billion ended up in the
U.S. Treasury. The licenses do not convey
ownership rights to spectrum. For example,
if a company is licensed to deliver satellite
radio services, it may not decide on its own to
use the spectrum for terrestrial services. The
licensee enjoys exclusive use of the allocated
bandwidth – but only to operate as regulators
specify.
This sharply limits competition. For example,
satellite radio operators cannot confront
local radio stations with a truly competitive
product because they are not allowed to deliver
local news or other programs by means of
supplementary terrestrial broadcasts. And, no
surprise, such rigidities are strongly supported
by incumbent licensees.
Potential users must petition the agency to
gain a spectrum allocation, proving that their
new wireless systems serve “the public interest.”
The claims are, of course, challenged –
and rechallenged – by incumbents bearing
lawyers. In the rare case in which an entrepreneur
wins FCC support to provide a novel
wireless service, he or she wins thanks – but
not a license. The innovator must, instead,
buy one at auction. In the final humiliation of
the upstart, the FCC pockets much of the
expected economic profit from new use of
spectrum, while rival firms are given an

opportunity to outbid the innovator and
appropriate the business model.
Multiply this maze of roadblocks and disincentives
by an order of worldly magnitude.
Scores of new wireless technologies are stifled
as their inventors struggle to scale regulatory
walls; scores more remain undiscovered as
economic incentives to research and development
are eviscerated. Inefficiencies
plague technical progress – for example,
Americans view TV pixels
arrayed as per the state-ofthe-
art standard of 1941.

allocation in countries of
the European Union.

punts
In the Spectrum Policy Task
Force Report, the misallocation
problem is outlined in
standard terms.Curiously, however,
new technology is cited as the
villain. Until the wonders of the digital
era, we are told, demand for spectrum access
was low and the old regime worked reasonably
well. Now, new rules are needed for new
times. Policymakers should understand that
“one size does not fit all,” and pick their regulatory
models with care. Their choices, the
report states, are three:
1. Exclusive use, in which a licensee has
exclusive, flexible and transferable rights to
use specified spectrum. Think cellular telephone
services.
2. The commons, which allows unlimited
numbers to share frequencies set aside for
unlicensed use, with operations restricted
through power limits and technical standards,
but with no right to protection from
interference. Think cordless phones.
3. Command-and-control, traditional spectrum
management in the U.S. in which regulators
mandate spectrum for specific uses via
regulated technologies. Think over-the-airTV.
The report builds its assessment on this
taxonomy, arguing that models 1 and 2
should be extended, and model 3 attenuated.
It offers only vague criteria for selecting the
appropriate model, advising that the Commission
must not forget that “one size does
not fit all.” The hoary “public interest” standard
almost looks definitive by comparison.
The report offers a sort of false trichotomy,
with very costly implications. By quarantining
property rights to the “exclusive use”
slot, it misses the essential fact that private
economic incentives drive spectrum use

everywhere. Unlicensed bands prosper not by
abolishing exclusivity, but by giving users the
ability to assert very localized rights. The Starbucks
Wi-Fi hotspot network uses unlicensed
frequencies, but Starbucks and its partner, TMobile,
only invest to create their network in
the expectation that they will be able to prevent
free-riding.
This expectation rests in part on TMobile’s
exclusion of non-subscribers, and in
part on the Commission’s tight limits on
transmission power, which keeps neighboring
frequencies apart. But by ignoring the potential
for exclusivity embedded in the electromagnetic
commons, the Commission stops
short of seeing how entrepreneurial initiative
could be extended.Why not allow Starbucks –
or university and corporate networks – to
exclude interlopers or to enjoin malicious
interference?
The Commission’s taxonomy also misses
the huge importance of the “commons” embedded
within the “exclusive.” The most successful
spectrum-sharing now takes place
under the auspices of cellular and personal
communications services (PCS) licensees –
the closest we have to spectrum owners –
which organize collective use of airwaves for
more than 150 million mobile phone subscribers,
thousands of manufacturers (from
chipmakers to handset suppliers) and scores
of virtual networks (from personal digital
assistants to text-based wireless Web applications).
The average consumer cost is 10 cents
a minute, including long distance and roaming.
If these networks were allowed to use
additional spectrum, they would undoubtedly
expand into high-speed data, providing
ubiquitous coverage for Internet access
(now lacking with Wi-Fi hotspots).
Indeed, a company called Monet
Networks now provides 300 kbps to
700 kbps wireless access to subscribers
at prices comparable to
cable modems and DSL. Monet is
licensed to operate on PCS frequencies
in the upper Midwest, where
wireless voice traffic is less dense.
Market solutions, it seems, rush in
where licenses are flexible (as in
PCS), and spectrum access is cheap.
Injecting more flexible, exclusive-use
spectrum rights into the market would pump
up all kinds of wireless applications, including
those of the “commons.”
But on the question of freeing spectrum
for flexible, exclusive use, the report is a flop.
The FCC’s November 1999 spectrum policy
statement specifically targeted 183 MHz to be
transferred to five service categories, with
licensees awarded liberal use rights. The task
force provides no progress report on that
goal; if it had bothered, it might have noted
two salient points. First, none of the 183 MHz
services had been put into productive use in
the intervening three years. Second, this policy
failure is incessant – a reality that begs for
an explanation.Why does the FCC have such
a difficult time making good on its plans to

expand market access to radio spectrum?
The problem lies in “command-and-control”
spectrum allocation, which the report
ignores altogether. Indeed, it embraces this
approach by arguing for administrative discretion
in avoiding “one size fits all,” and
using vague criteria to pick and choose
between more exclusive spectrum here, more
unlicensed spectrum there. A consumerfriendly
solution would allow markets to
determine how airwaves are used.
the fcc zones more spectrum
That command-and-control clings to life in
the Commission’s spectrum regime is illustrated
vividly in the first agency rulemaking
in response to the report. In December 2002,
a Notice of Inquiry was issued to consider
rules allowing unlicensed devices to share
television channels. The notice pats the
agency on the back, noting that:
The Commission’s rules for unlicensed
transmitters have been a tremendous success.
Awide varietyof devices have beendeveloped
and introduced under these rules for consumer
and business use, including cordless
telephones, home security systems, electronic
toys, antipilfering and inventory control
systems and computer local area networks.…
The success of our unlicensed device rules …
shows that there could be significant benefits
to the economy, businesses and the general
public in making additional spectrum available
for unlicensed transmitters.
Missing in the notice is any sense of what
unlicensed use may have cost. No mention is
made of the alternatives sacrificed so that the
2.4 GHz band could be reserved for cordless
phones, wireless local networks and other
applications. But let’s assume that the existing
band is every bit the smashing success the
Commission means to assert. This does not
imply that allocating the next band to unlicensed
use will produce similar results.
Indeed, an argument for unlicensed spectrum
cited by the report is to encourage users
to invest in equipment that overcomes crowding.
Perhaps the 2.4 GHz unlicensed band
should continue to develop on this margin,
using more sophisticated technology to permit
more intensive exploitation of the current
allocation.
It all depends. How much do the upgrades
cost? What other technologies are waiting to
use the TV band, and how important are
they? Which can be efficiently shared with
low-power applications, and which need
bandwidth all to themselves?
The FCC does not know and does not try
to learn. That, after all, would be to take on
what the task force called the “almost impossible
task of trying to keep pace with the everincreasing
demand for spectrum and the continuing
advances in wireless technology and
applications.”
Instead, the report simply assumes away
the issue. In advancing an allocation limiting
new TV band use to unlicensed devices selected
by regulators, government planners defoliate
the “almost impossible” thicket they profess
to fear. A vast array of wireless technologies
will be precluded by the FCC’s edict,
which mandates those systems most appealing
to commissioners.
But first, we wait. A long delay was officially
kicked off in December 2002. Champions
of unlicensed devices will now seek rules to
share channels with TV broadcasters. Insiders
familiar with the FCC’s interest group pecking
order may liken this to a nature documentary
featuring a pack of hyenas cornering
a gimpy antelope. Except these predators will
chew their meals very slowly.
a cheap spectrum policy
There is a market solution. In 1996, the then-
Chair of the Senate Commerce Committee,

South Dakota Republican Larry Pressler, proposed
issuing “overlays” to reallocate TV
spectrum. This approach would grandfather
existing TV stations, while allowing new
licensees to use the “white space” around
incumbents’ signals. Entrants could then
attempt to negotiate voluntary agreements in
which, for a price, the old users move and
release their spectrum for new services. The
idea builds on the overlays used in PCS,
where new licensees either avoided incumbents’
transmissions or paid them to relocate.
Such overlays would effectively establish
ownership, triggering market solutions.
Instead of government-imposed interference
standards determining if radio can share frequencies
used by a UHF TV station, the overlay
rights holder searches for a profitable
solution. In particular, these owners would
voluntarily select from a rich mix of interference
rules and spectrum-sharing arrangements
in a competitive quest for product
development. If new “software defined”
radios – or other technologies – can share
spectrum with TV broadcasters, market
incentives will drive implementation. The
degree of interference permitted would be
subject to negotiation between the parties.
ArrayComm – the provider of an innovative
technology offering high-speed wireless
Internet access in Australia – does not fit the
FCC’s preferred regulatory dress in the TV
band. The firm told the task force that it opposes
“the indiscriminate call for more unlicensed
spectrum” as the broadband solution.
With the power limits necessary to keep unlicensed
users in their own space, “one would
have to deploy hundreds of thousands of
access points” to rival the national coverage
they could deliver (using higher emission levels
in licensed spectrum) with about 20,000
sites. ArrayComm objects to the “uncritical
exaltation of unlicensed spectrum.” Yet, the
Spectrum Policy Task Force Report proposes
large new unlicensed allocations, while
planned licensed allocations are actually
reduced.
The task force report proposed just 100
MHz of bandwidth for new licensed services
over five years. This shrank the (entirely unfulfilled)
183 MHz proposal of three years
previous, and was tiny in comparison to an
FCC senior staff proposal issued the same
day. The latter asked the Commission to auction
flexible rights for the use of 438 MHz of
the most valuable portions of the spectrum in
a “big bang.” The policy would give spectrum
markets the scale and liquidity to invite substantial
risk capital.
commands and controls
With the tepid task force proposal for licensed
spectrum, however, innovative market structures
are destroyed even before they are imagined.
The result will not be mitigated by the
report’s misplaced attention on front-loading
interference standards. The report states that
the Commission must “[c]learly and exhaustively
define spectrum users’ rights and
responsibilities.” But trying to anticipate the
myriad dimensions of conflict merely delays
competition. The productive solution is to
authorize new users quickly while planning

for fair and efficient dispute resolution. New
rules are generally not needed; if the FCC
already has one thing going for it, it is an
abundance of administrative law. Historical
practice forms the basis of reasonable expectations.
Other countries have not found it
chaotic to define rights to radio spectrum in
sketchy fashion, allowing arbitrators and
courts to resolve issues as they arise.
In 1996, for example, Guatemala introduced
explicit spectrum property rights.
Spectrum users define their airspace with six
simple variables: frequency, location, hours of
operation, maximum transmission power,
maximum power emitted at the border of
adjacent frequencies, and duration of the
right. In such an environment, a thousand
market structures can bloom, along with
rules to accommodate them.
Even when advocating deregulation,
the report embraces command-andcontrol.
For instance, in its frustration
with rules that waste spectrum in the name
of protecting antiquated technologies, the
Commission recommends regulations
for receiving equipment – a major
extension of the Commission’s mandate.
But poor receivers do not cause interference;
they are a problem because the FCC continues
to block new uses that might make them
obsolete.
The call for regulation is a plea for help:
Stop me before I protect low quality receivers
again. The better approach, surely, is for
structural reforms that eliminate this interference
at its source – namely, at the FCC.
The “command-and-control” that the
report ostensibly schedules for phasing out is
continually resuscitated with technocratic
determination. Consider, for example, how a
receiver standard for transistor radios would
play out. With better radios, more stations
might be able to broadcast in a specific locality,
giving listeners more choices. Let us assume
that the new programs are worth the
extra cost of designing and manufacturing
better radios. Yet, some consumers, perhaps
in rural areas where the new stations are unlikely
to materialize, will not want to pay for
new equipment. Receiver standards set by
government bludgeon the resolution of these
differences, imposing a political one-size-fitsall
fix. This, according to the Spectrum Policy
Task Force Report, is just where we do not
want to be.
The FCC, it seems, is caught between an
acknowledgement of the compelling need to
let markets decide how spectrum is used and
an irresistible urge to force the market to
accept the Commission’s guesses about how
spectrum can be used most efficiently.
Consumers are paying the price for the contradiction
and – if this report is a forecast of
future Commission policies – will continue to
do so for years to come.

Rapidly expanding voice communications over the Internet should be protected
from excessive government regulation and from being pigeonholed as
traditional phone service, the top U.S. telecommunications regulator said on
Friday.

Harm from misregulation of Internet phone service could take "decades to
fix," said Federal Communications Commission Chairman Michael Powell,
speaking at the Consumer Electronics Show here. "You (can) create a very
hostile regulatory environment for voice-over-IP providers in the United
States," Powell said.


Powell's comments were welcomed by the largest provider of Internet-based
phone service, Vonage Holdings Corp., http://www.vonage.com which has
92,000 customers and is expecting 250,000 customers by the end of the year.


"One thing you don't want to do is accelerate the movement of technology,
jobs and infrastructure away from the United States, and outside the reach
of the government if they ever want to reach into it," Vonage Chief
Executive Jeffrey Citron said in an interview with Reuters.


Companies like privately held Vonage have seen rapid growth in recent months
as people embrace lower-cost communications online with quality comparable
to traditional phone service. The technology has recently attracted the
attention of large telecommunications providers including AT&T Corp., which
also intend to provide Internet phone service.


In other comments, Powell said his commission needs to do more work this
year on promoting and expanding high-speed communications over the Internet,
which he said is crucial to the economy's future.


"I think it is the most dramatic and meaningful stimulus to our economic
productivity and growth," he said. "I think it is the most promising
development for job creation."


Powell, however, was most vocal about the technology known as voice over
Internet protocol, or VoIP.


He added "there is nothing to stop" the companies from moving to other
countries and setting up computer systems to serve U.S. customers.


A major danger, he said, is people saying "'Oh VoIP, it's just telephony. It
looks like a duck; it quacks like a duck; regulate it like a duck."'


GRAPPLING WITH REGULATIONS


Last year, the state of Minnesota tried to impose telephone regulations on
Vonage, a leader in the VoIP business that lets a user hook up a regular
telephone to a special adapter and in some cases even keep their traditional
phone number.


But a federal judge ruled in October that Vonage was an information service
rather than a telecommunications service, and that state regulation of it
would run counter to congressional intent to keep the Internet free of
regulation.


"We should be starting on the cleanest slate possible," Powell said. "I
don't think you should ask a Vonage ... to hire an 80-person lobbying staff
and legal staff."


Indeed, Vonage's Citron said the Minnesota case was very costly to the
Edison, New Jersey-based company, even though it prevailed in the case,
which he called a "travesty."


"It's very expensive to fight the government," he said.
